Supreme Court Sides with Pro-Life Pregnancy Centers in Major Free Speech Case

The U.S. Supreme Court has issued a unanimous decision supporting a faith-based pregnancy center in a case that raises significant questions about religious freedom, donor privacy, and the rights of pro-life ministries.

In its ruling, the Court determined that First Choice Women’s Resource Centers may challenge a sweeping subpoena issued by New Jersey Attorney General Matthew Platkin in federal court, according to LifeSiteNews and LifeNews. The subpoena sought extensive internal records, including sensitive donor information such as names, addresses, phone numbers, and even employment details.

Justice Neil Gorsuch, writing for the Court, emphasized the constitutional concerns at stake. “An official demand for private donor information is enough to discourage reasonable individuals from associating with a group,” he wrote, noting that such actions can have a chilling effect on free association. The Court’s decision reverses lower court rulings that had required the pregnancy center to first contest the subpoena within New Jersey’s state courts. Instead, the justices affirmed that the organization has standing to bring its constitutional claims directly in federal court.

First Choice Women’s Resource Centers, a Christian nonprofit that has operated since 1985, provides services such as parenting classes, free ultrasounds, and material support for mothers in need. According to LifeNews, the group argued that the subpoena—issued without any formal allegation of wrongdoing—placed an unjust burden on its mission and supporters.

“An injury in fact arises when a defendant burdens a plaintiff’s constitutional rights, and government demands for a charity’s private donor information have just that effect,” Gorsuch wrote in the opinion, as reported by LifeNews.

Leaders of the organization welcomed the decision as a victory not only for their ministry but for pro-life efforts nationwide. Executive Director Aimee Huber said the legal battle has stretched on for years and described the state’s actions as targeting their work. “For more than two years, Attorney General Platkin targeted First Choice with aggressive demands for sensitive documents, including our donors’ identities,” she said, according to LifeNews.

Huber also warned of broader implications if such actions were allowed to continue unchecked. “If our attorney general can bully us, it can happen in other states that promote abortion,” she said.

Attorneys representing the center echoed those concerns. Erin Hawley of Alliance Defending Freedom called the ruling a reaffirmation of constitutional protections. “The Constitution protects First Choice and its donors from demands by a hostile state official to disclose donor identities and contact information,” she said, according to LifeNews.

The case arose in the wake of the Supreme Court’s 2022 decision overturning Roe v. Wade, after which New Jersey officials launched initiatives that included scrutiny of pro-life pregnancy centers. According to LifeSiteNews, the subpoena did not explain the need for donor records and did not allege any specific wrongdoing, while also warning of potential penalties for noncompliance.
