DOJ Lawyers Discussed Prosecuting Catholic Nuns for Wearing Traditional Habits, Senate Probe Reveals

A newly revealed Senate investigation is raising serious concerns among Catholics and other people of faith after reports surfaced that Department of Justice lawyers under the Biden administration discussed prosecuting Catholic nuns for their religious attire.

According to LifeSiteNews, the communications were uncovered as part of an inquiry led by Senator Chuck Grassley, chairman of the Senate Judiciary Committee. The messages, exchanged in February 2021 between prosecutors Joseph Cooney and Molly Gaston, referenced images of Catholic nuns attending a public rally while wearing traditional habits and veils.

In the messages, Gaston expressed a desire to take legal action, stating, “I would like to take a special assignment of finding and prosecuting them,” to which Cooney replied, “I’m with you,” later adding that he would like “to prosecute any nun who still wears the head habit,” according to LifeSiteNews.

The remarks have drawn strong criticism, particularly from those who see them as a direct affront to religious liberty. Senator Grassley voiced his concern, saying, “Freedom of religion is a cherished First Amendment right enshrined in our Constitution by the Founding Fathers,” and added that he was “appalled” by what he described as evidence of federal officials considering the use of government power against people of faith, according to LifeSiteNews.

The controversy has also renewed attention on previous federal actions involving traditional Catholics. LifeSiteNews reports that in 2023, a leaked FBI memo from the Richmond Field Office described “Radical Traditionalist Catholic Ideology” as a potential draw for “violent extremists” and suggested links to “white nationalists.” The document proposed monitoring and developing sources within Catholic communities, including those connected to the Traditional Latin Mass.

The memo relied in part on research from the Southern Poverty Law Center, despite longstanding criticism of the organization’s credibility in such matters, and cited articles from publications including Salon and The Atlantic to support its claims, according to LifeSiteNews.

Public reaction to the memo was swift and widespread, with critics arguing it unfairly targeted Catholics based on their religious beliefs. The backlash prompted the FBI to retract the document and open an internal review.

Further developments came during a September 2025 Senate Judiciary Committee hearing, when FBI Director Kash Patel stated that officials involved in the drafting and dissemination of the memo had been dismissed, according to LifeSiteNews.
