California Rejects Federal Order on Transgender Athletes, Keeps Males in Girls’ Sports

California may soon be at the center of a historic legal battle—one that strikes at the very heart of truth, justice, and the dignity of the human person. The Department of Justice is reportedly preparing a lawsuit against the California Department of Education and the California Interscholastic Federation (CIF) for their refusal to prohibit males from competing in girls’ sports. Despite a federal mandate to comply with Title IX, the state continues to allow what Education Secretary Linda McMahon called “gender-confused men” to dominate female competitions.

“Our daughters deserve fair competition, not politically driven injustice,” said McMahon in a July 8 post on X. “California has just REJECTED our resolution agreement to follow federal law and keep men out of women’s sports.” The resolution would have not only banned males from competing in girls’ sports, but also required the state to rescind illegitimately earned records and awards and issue a formal apology to female athletes.

This controversy reveals far more than a legal dispute—it reflects a deep moral crisis rooted in the rejection of biological reality and divine order. For Catholics, this is not merely a political issue; it is a matter of defending truth and protecting the dignity of women, who are being erased in the name of “inclusion.”

Title IX was established to ensure that women and girls had equal access and opportunity in education and athletics. It was never intended to permit men to self-identify into women’s categories. According to Sarah Parshall Perry, legal expert with Defending Education and the Heritage Foundation, “Break the law, suffer the consequences.” Another expert, Nicki Neily, pointed out, “California isn’t just ignoring federal law — it’s actively siding against fairness for women and girls.”

The Department of Education gave the state until Monday to comply. Instead, California doubled down. The implications of this defiance go beyond legal boundaries—they point to a dangerous cultural trend where ideology is allowed to override reality.

Governor Gavin Newsom, while acknowledging the unfairness of males in female sports, ultimately refused to take action. “I think it’s an issue of fairness. I completely agree with you on that,” he told Turning Point USA’s Charlie Kirk. “I’m not wrestling with the fairness issue. I totally agree with you… I revere sports.” Yet, in the same breath, Newsom justified inaction, stating, “These poor people are more likely to commit suicide, have anxiety and depression… So both things I can hold in my hand.”

But for Catholics, truth is not negotiable. Compassion must never come at the cost of justice. What kind of compassion sacrifices young women on the altar of ideological conformity? The Catechism of the Catholic Church teaches that “[everyone] must acknowledge and accept his sexual identity” (CCC 2333). To reject the natural distinction between male and female is to rebel against the Creator Himself.

The Trump administration has made it clear that it will enforce Title IX. “The Trump Administration will relentlessly enforce Title IX protections for women and girls,” McMahon warned. She emphasized that California “must swiftly come into compliance… or face the consequences that follow.”

According to HeCheated.org, there have been nearly 400 instances of males competing in girls’ sports in California since 2019, just in track and field. These include multiple wins by a biologically male athlete listed as “AB Hernandez.” Each of these cases represents a young woman robbed of a fair opportunity—robbed not only of medals, but of dignity.

This case comes on the heels of a separate agreement with the University of Pennsylvania, which once permitted male swimmer William “Lia” Thomas to dominate the women’s swim team. As part of a resolution, the university agreed to revoke Thomas’s school records, issue a formal apology, and prohibit men from entering female locker rooms and restrooms.

The Church calls us to act with both charity and truth. As Pope Benedict XVI once wrote, “Without truth, charity degenerates into sentimentality.” To allow male athletes to overtake girls’ sports is not charity—it is cowardice dressed in false compassion. It is injustice against women, an affront to truth, and an abandonment of the moral order.

California now stands at a crossroads. It can either defend truth or continue down a path of ideological delusion. In the meantime, Catholics must raise their voices—not in hatred, but in courage and conviction. Our daughters deserve better. And so does our nation.
